Supreme Court Rejects Trump Campaign’s Appeal, Affirms Biden’s Win

The Nevada Supreme Court on Tuesday night rejected President Trump’s appeal to overturn the state’s election results, affirming President-elect Joe Biden’s win in the 2020 battleground.

The decision comes after a court ruled last week against the Trump campaign, stating that the president’s team was unable to prove that there were fraudulent results due to malfunctions with voting devices in the state, Reuters noted.

“We also are not convinced that the district court erred in applying a burden of proof by clear and convincing evidence, as supported by the cases cited in the district court’s order,” Nevada’s Supreme Court said in its judgment.

Trump’s lawsuit in Nevada originally asserted unproven allegations that more than 61,000 people voted twice or voted and were not Nevada residents. Nevada Attorney General Aaron Ford (D) asked Trump’s lawyer Jesse R. Binnal to provide evidence to back his claim that the state’s election was “stolen,” but he was unable to do so, The Washington Post reported.

“They never once presented sufficient evidence of widespread fraud. Yes, they spouted nonsense in the media. But they NEVER backed it up in court. That’s why they always lost. And that’s why they lost again tonight,” Ford wrote on Twitter early Wednesday.

The Nevada Republican Party expressed its disappointment in the decision in a statement on Tuesday.

“We were not afforded an opportunity to write our brief or argue the case in front of the Supreme Court. Full denial of legitimate due process and appellate rights is truly unprecedented, shocking and extraordinary,” the party said.

Biden won in Nevada by 33,596 votes, securing the state’s six Electoral College votes. Electors are set to finalize the results of the election on Monday, with Biden garnering a total of 306 electoral votes to Trump’s 232, Reuters noted.

Trump has refused to concede the election, and his campaign has been unsuccessful in multiple challenges to election results across the country.
