Federal High Court sitting in Abuja, on Thursday rejected an ex-parte application for an order to stop the Nigerian Police Force and the Attorney General of the Federation and Minister of Justice, Abubakar Malami, SAN, from arresting and extraditing the suspended Deputy Commissioner of Police, DCP, Abba Kyari.
Justice Ahmed Mohammed, declined the motion which was filed by a group under the aegis of the Incorporated Trustees of Northern Peace Foundation, rather he ordered the Applicants, through their lawyer, Dr. Olukayode Ajulo, to turn the ex-parte application a motion on notice and serve all the relevant processes on Police and AGF.
GIOTV recalls that the United States Department of Justice had said ongoing investigations showed that Hushpuppi allegedly bribed Kyari to arrest one Kelly Chibuzo Vincent, one of his accomplices in Nigeria.
According to a court document released by the United States Department of Justice, titled: ‘Six Indicted in International Scheme to Defraud Qatari School Founder and then Launder over $1 Million in Illicit Proceeds’, Kyari was said to have been bribed to arrest one Kelly Chibuzor Vincent, 40, in Nigeria, who created bogus documents and arranged for the creation of a fake bank website and phone banking line to support the defrauding of a business person trying to provide $1.1m for the funding of a school in Qatar.
The police set up a Special Investigation Panel (SIP) made up of four-man panel headed by the Deputy Inspector -General of Police in charge of the Force Criminal Investigations Department, Joseph Egbunike to investigate the embattled DCP Kyari.
The court subsequently adjourned the matter till September 9 for mention.
The Incorporated Trustees of Northern Peace Foundation had supported the ex-parte application dated August 9, with a 21- paragraphed affidavit of urgency.
